Today, we will be talking about Intellectual Property rights and how violating them can cause a suspension. Before the suspension part, let’s together discuss Intellectual Property rights and what Amazon thinks about them!

If you’re following us and are always up to date with the insights we publish, then you surely know that there are three main types of intellectual property rights. These types are:

  • Copyrights – according to the U.S. Copyright office, this is a form of protection for original works of authorship fixed in a tangible medium of expression. Copyright covers both published and unpublished works.
  • Trademarks – uspto.gov says a trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others.
  • Patents – according to the U.S. Patent and Trademark office, a patent for an invention is the grant of a property right to the inventor, issued by the United States Patent and Trademark Office.

Amazon Regulations Related to IP Rights

Referring to Amazon’s website, you should comply with all federal, state, and local laws and Amazon policies applicable to your products and product listings. This means that even on Amazon you shouldn’t forget about law and regulations: everything should be legitimate, remember!

Right off the bat, Amazon warns its sellers that violating the IP rights of brands or other rights owners, and violating its policy about IP rights may result in loss of selling privileges or other legal consequences. So, if you want to have a profitable and stable business, you have to focus not only on Amazon itself, but also on the regulations existing in your state and country.

A True Nightmare

Yes, problems with intellectual property rights always turn into a complete nightmare. You know why? Because you get the worst of both worlds! On one hand, you have to resolve the issue with Amazon and get reinstated, and on the other, you have to settle the problem you have with law!

If you succeed and the brand retracts their complaint, you can start appealing the suspension. Otherwise, Amazon won’t have a solid guarantee that you’re capable of solving this situation.

Pay Attention to…

Pay attention to the appeal itself, how you structure it and what words you use. For example, you shouldn’t include the part with retractions in your root cause because this doesn’t explain why your account was suspended. Before writing anything, make sure you respond to a certain question. More specifically, if Amazon wants you to explain why the suspension happened, you need to explain which actions brought you to this point.

Show Amazon that you realize your mistake, and that you’re ready to change. Without that, Amazon won’t be able to make a decision and therefore, reinstate your account. Here’s a tip: never blame Amazon for suspensions, and never try to sue the platform! Do the opposite: show them that you understand the importance of Amazon policies and that you’re ready to change.

P.S. unintentional actions that violate others’ rights are not an excuse! Amazon itself says that even if a seller is infringing IP without knowledge, they will still take action and the seller’s account might receive a warning or be suspended.
