How to Resolve Amazon Used Sold as New Condition Complaints

By July 21, 2026November 2nd, 2026No Comments24 min read

An Amazon used sold as new complaint means a buyer received an item listed as New that arrived opened, used or damaged. Amazon’s condition guidelines define New as a brand-new item, with the original manufacturer’s warranty still applying where there is one and original packaging present for most items. When buyers report units that do not meet that standard, the listing can be removed and the complaint counts against your Account Health, and repeated complaints can lead to deactivation. Most of these cases start in the same place, a returned unit that went back into New stock without inspection. The fix that holds is a return grading routine that sends every opened or used unit to the correct condition before it can be sold again. Product condition guidelines are one of the policies Amazon counts in the Account Health Rating, so a pattern of these complaints moves a 0 to 1,000 score that decides whether the account stays open.

What Amazon Means by New Condition and Used Sold as New

Amazon’s condition guidelines tell sellers to assess each product carefully before choosing its condition, and they apply to all product categories unless a category page says otherwise. The general guidelines then define each condition. New is short and strict, just like it sounds, a brand-new item. The original manufacturer’s warranty, if any, still applies, with warranty details included in the listing comments. Original packaging is present for most New items, though certain items such as shoes may be re-boxed.

Read that definition against a returned unit and the problem is clear. A unit a customer opened, used, tried on or partly assembled is no longer brand-new, whatever it looks like. A unit with a damaged or missing original package fails the packaging expectation for most categories. A unit whose warranty no longer runs from the buyer’s purchase date may fail the warranty element. Any of these sold as New gives the buyer a fair complaint.

The conditions below New

Amazon gives sellers somewhere honest to put every unit that is not brand-new. The general guidelines describe these conditions.

  • Renewed. A pre-owned product inspected and tested to work and look like new by an Amazon-qualified supplier or by Amazon. It shows no visible cosmetic imperfections when held 12 inches away and carries a replacement or refund warranty within 90 days of purchase. Only qualified suppliers list in Renewed, so an ordinary return does not belong there.
  • Rental. A product inspected and graded by a qualified supplier, in working condition with no structural imperfections that affect function, possibly in a generic box.
  • Used, Like New or Open Box. An item in perfect working condition. Original protective wrapping may be missing, but the original packaging is intact and in good condition with minor damage possible, and instructions are included.
  • Used, Very Good. A well-cared-for item with limited use, possibly small scratches or blemishes, possibly damaged or replaced packaging and possibly missing accessories that are clearly listed.
  • Used, Good. Wear from consistent use, still in good condition and working properly, possibly marked or missing some parts or accessories.
  • Used, Acceptable. Fairly worn but still working, with aesthetic issues such as scratches, dents and worn corners, and possibly missing parts.
  • Collectible. Items that carry added value, such as an autograph or an out-of-print edition, with a description that justifies it.

Amazon also publishes category-specific condition guidelines, and the US page links 15 of them. They cover books, electronics, camera and photo, software and computer games, cell phones, personal computers, consumer electronics, toys and games, home and garden, video and discs, video games, tools and hardware, watches, consumable and topical products, medical devices and intimate apparel. A category page overrides the general definitions for that category, so read it before you grade a return there.

Items that cannot be listed in any condition

The guidelines also list items that are unacceptable for listing. These include items that are not clean, items damaged in a way that makes them hard to use, items missing essential accompanying material or parts, items that need repair or service, items not made by the original manufacturer, promotional copies or samples, items past their expiration date or with too little shelf life left, and items the manufacturer or a supplier designated for destruction or as unsellable. A returned unit in any of these states has no condition on Amazon. It goes to disposal, repair or another channel.

How condition fits into Account Health

Product condition guidelines sit on Amazon’s list of policies included in the Account Health Rating, next to the fair pricing, restricted products and anti-counterfeiting policies. New sellers start the AHR at 200. A score from 200 to 1,000 shows green as Healthy, 100 to 199 shows yellow as At Risk, and 99 or lower shows red as Unhealthy, where the account is eligible for deactivation or already deactivated. Amazon weighs each violation by one of four severity levels, critical, high, medium and low, and counts selling activity from the trailing 180 days. A condition violation shows on the Account Health page tied to a specific ASIN. Copy the policy name exactly as your dashboard shows it, because the reviewer will match your response to that label.

How Used Sold as New Complaints Arise

A buyer opens the box and sees something that does not look brand-new, such as a broken seal, a missing film, scuffs, hair or fingerprints, a used consumable, a missing accessory, a package that has clearly been taped shut before, or a setup that remembers a previous user. The buyer reports it in a return reason, a review, a message or a complaint. Amazon reviews the listing and, where it agrees the condition was misrepresented, removes the listing and records the violation.

Reviewers look at the path a unit takes from return to resale. The diagnostic question we ask first is whether returned units ever go back into New stock. In the cases we work, that is where most of these complaints start. The other common sources are stock bought as New that was not New, and packaging that did not protect the unit on its way to the buyer.

The business models that produce these complaints

  • Merchant-fulfilled sellers who restock their own returns. Returns arrive at your warehouse and someone puts them back on the shelf. Without an inspection step, the next buyer receives the previous buyer’s opened unit.
  • Liquidation and returns-pallet resellers. Customer returns pallets are mixed by nature. Some units are sealed, many are not. If the lot is graded as a whole, opened units are listed as New.
  • Sellers shipping fragile items in thin packaging. Damage in transit reaches the buyer as a crushed box, a scratched surface or a broken part, and the buyer reports it as used.

Each model can be run compliantly. Inspect every return before it re-enters stock and list anything opened as Used with an honest condition note. Buy liquidation stock only where you can grade units individually. Upgrade packaging on any SKU with damage complaints. Train everyone who touches inventory on Amazon’s condition guidelines, so grading is a shared standard and not one person’s judgment.

First complaint compared with repeat complaints

A complaint removes the listing and deducts Account Health points. Amazon’s Account Health Rating policy explains what happens if it continues. The points for a violation increase with each repeat of the same policy, and an account can be at immediate risk of deactivation if it reaches the maximum number of repeat violations for one policy within 180 days, which Amazon states can be as low as two for higher severity violations. A first complaint answered with a real fix usually stays at the listing. A pattern of complaints across ASINs is a returns process problem, and Amazon treats it as one. Buyers who receive opened units also file returns and negative feedback, which feeds the order defect rate above 1 percent problem at the same time. Our guides on fixing used sold as new complaints before they repeat and on repeated condition complaints and deactivation cover each stage in detail.

Returns, Packaging and Inspection Failures

Every used sold as new case we have seen traces to one of three failure points. Naming the right one is the root cause in your appeal, and fixing it is the preventive measure.

Failure point 1. Returns restocking

The unit came back from a customer and went back into sellable New stock without being opened and inspected. Common versions.

  • A warehouse rule that restocks any return “in the original box” without opening the box.
  • Returns processed by temporary staff with no grading standard.
  • Returned units mixed into the same bin as new stock, so the next pick has no way to tell them apart.
  • Resealing a returned unit with tape or shrink wrap so it looks unopened.

The last item deserves a direct warning. Resealing a used unit to sell it as New is the conduct the complaint describes, and a reviewer who sees it in your process will treat the case seriously.

Failure point 2. Condition grading at intake

The unit was not New when you bought it. Open-box retail stock, customer returns pallets, shelf-pulls and overstock from other sellers can include units that have been opened, displayed or used. If intake grades the lot by its label and not by each unit, those units go out as New. The fix is unit-level grading at intake, recorded per unit or per small batch.

Failure point 3. Packaging

The unit left your warehouse New and arrived looking used. A thin mailer, no void fill or a product box used as the shipping box exposes the item to crushing and scuffing. Buyers do not distinguish between transit damage and prior use. They see a damaged item sold as New. For sellers who ship their own orders, the fix is a packaging specification per SKU. For FBA sellers, it is the product packaging and any prep Amazon requires for the category.

Grading liquidation and returns lots at intake

Sellers who buy customer returns pallets or open-box lots carry the highest risk, because the stock was never guaranteed New in the first place. We set intake up so that the grade belongs to each unit and never to the lot.

  1. Receive the lot into quarantine. Nothing from a returns lot goes near sellable stock until it is graded.
  2. Open and grade each unit. Use the same checklist as for your own returns. A sealed unit with an intact factory seal can be New. Everything else is graded as Used or rejected.
  3. Label the grade on the unit. A grade sticker or a used-condition SKU label makes the grade visible to everyone who handles the unit later.
  4. Record the lot result. Units received, units graded New, units graded each used condition, units rejected. This tells you what the lot was worth and gives you evidence if a buyer complaint arrives later.
  5. Price the lot on its graded mix. Over time your records show which suppliers send lots that grade well. That data belongs in your buying decisions.

If a supplier will not let you grade units individually, either because the lot is sealed for resale or because the volume makes it uneconomic, treat the whole lot as used stock. Listing an ungraded returns lot as New is the single most reliable way to collect used sold as new complaints.

Where FBA returns fit

Sellers using FBA often assume returns are Amazon’s problem. When a customer returns an FBA order, the unit goes back to a fulfillment center and is assessed there. You can review the outcome of each return in your Seller Central reports and arrange removal of units you do not want resold. Do not rely on Amazon’s assessment of returned units alone for sensitive categories. Review your FBA returns data regularly, and where a SKU shows condition complaints, remove returned units to inspect them yourself.

Appealing a Condition Removal

When a listing is removed for a condition complaint, the response goes through the Account Health page, using the appeal option next to the violation. We build every condition appeal in the same order.

1. The decision and your position

Name the notice and the policy exactly as Amazon wrote them. State your position in one sentence. For most sellers it is that the units shipped as described in general, and the specific concern traces to packaging damage or a returned unit restocked without inspection. If a returned unit was resold as New, say so plainly. Reviewers reward a specific, owned answer.

2. The root cause, named at process level

Name the step that failed, whether returns restocking, condition grading at intake, or packaging. Then say how it failed. “Returned units were restocked by the packing team if the outer carton looked undamaged, without opening the product box. Order 113-XXXXXXX received such a unit” is a root cause a reviewer can test. Leave the buyer, the carrier and Amazon out of the root cause. A condition appeal that points at someone else tells the reviewer your returns shelf has not changed.

3. Corrective actions already taken

  • Pulled every unit of the affected SKU from sellable stock and inspected it, with the count.
  • Re-graded units that failed New into the correct used condition or removed them from sale.
  • Reviewed returns for the past period on the affected SKU and other SKUs, with the count.
  • Refunded or replaced the affected buyers.

Every line should carry a number. “Inspected 238 units, re-graded 14 to Used, Like New, disposed of 3” is evidence.

4. Preventive measures now in place

The preventive measure is a returns inspection step that guarantees only conforming units ship as New. Describe it concretely. Returns are quarantined in a separate location, opened and inspected against a written grading checklist, and assigned a condition before they can be moved to sellable stock. Name the owner and the audit cadence. If packaging was the cause, name the new packaging specification and the SKUs it covers.

5. Evidence that carries the case

  • The returns inspection procedure and grading checklist.
  • Inspection logs showing units checked, grades given and dates.
  • Returns records for the affected SKU.
  • Photos of current packaging, and of the quarantine and inspection area if it helps show the change.
  • Refund records for affected buyers.

List only what you can attach. A document named in the appeal and never provided weakens it. Where the reviewer questions whether stock was New when you bought it, supplier invoices carry the case, and our guide on invoice requests before an ASIN deactivation covers what Amazon accepts.

6. One clear request

Ask for reinstatement of the specific listing, on the basis that the condition failure is isolated and controlled. Leave legal arguments out of a first condition appeal. If you sell in the EU or UK, one closing line noting that you received the statement of reasons keeps your complaint rights on record without changing the tone.

A composite example

A composite case from our training material shows how the parts fit. A merchant-fulfilled seller of small kitchen appliances receives two condition complaints in a month on one ASIN. The listing is removed. The seller’s returns rule restocked any return whose outer carton looked undamaged. The appeal states the position, names the rule as the root cause, and lists the corrective actions, 61 units of the ASIN pulled and opened, 4 found with signs of use and re-graded to Used, Very Good, 2 with missing parts disposed of, both buyers refunded, and 90 days of returns across all ASINs reviewed. The preventive measure is a quarantine shelf, a written grading checklist and a weekly review by the operations manager. The evidence is the checklist, the inspection log and photos of the quarantine area. The request is reinstatement of the one ASIN. A reviewer can check every sentence in that appeal against the attachments, which is what makes it credible.

What Never to Relist as New

These are the units that cause complaints. None of them should go back on the shelf as New.

  • Any unit with a broken factory seal, a cut or replaced shrink wrap, or tape over the original closure.
  • Any unit the customer powered on, set up, assembled, wore, washed or used, even once.
  • Any unit missing a part, accessory, manual or insert that the new product includes.
  • Any unit in a damaged, dirty or written-on original package, in categories where original packaging is expected.
  • Any unit with personal data or settings left on it, such as electronics with a previous account.
  • Any consumable, topical or intimate product that has been opened. These usually cannot be resold at all. Check the category guidelines.
  • Any unit bought as part of an open-box or returns lot that you have not inspected individually.

Price regraded units as what they now are. Amazon’s fair pricing policy warnings are another AHR policy. Where a unit fails New but is clean, complete and working, list it in the used condition that fits, with a condition note that describes exactly what the buyer will receive. Where it fails the unacceptable list, it does not go on Amazon.

Return Grading Routine

The routine that prevents these complaints is short. What makes it work is that it runs on every return, every time, and leaves a record.

Quarantine every return

Returns go to a marked area separate from sellable stock. Nothing moves from that area to the sellable shelf without a grade recorded against it. This one physical change stops most used sold as new complaints by itself.

Open, inspect, grade

Open the product box as well as the shipping box. Check the seal, contents, accessories, manual, surface condition, signs of use and, for electronics, whether the device has been set up. Grade against Amazon’s condition definitions using a written checklist. Record the grade with the date, the inspector and the order it came from.

Route each grade

New goes back to New stock only if it is factory sealed and complete. Every other grade goes to its used condition with a condition note, to repair, or to disposal. Keep used stock in a different location and under a different SKU so a picker can never confuse the two.

Review weekly

Once a week, check return reasons and condition complaints by SKU. A SKU with repeat complaints gets a look at its packaging and its returns handling. A SKU with complaints and no returns history points to supplier quality or intake grading.

Return grading decision checklist
  • Factory seal. A broken, cut or replaced seal means the unit is not New.
  • Completeness. Missing parts, accessories, manuals or inserts mean Used with the missing items listed, or not sellable if necessary parts are missing.
  • Signs of use. Wear, marks, residue, odor or setup data mean Used, graded by extent.
  • Original packaging. A damaged or dirty package in a category that expects original packaging means the unit is not New.
  • Function. A unit that does not work properly goes to repair or disposal. Items needing repair are unacceptable for listing.
  • Opened consumable, topical or intimate products. Check the category rules. These are usually not sellable.
  • Record. The grade is logged with date, inspector and order ID before the unit leaves quarantine.

The rules around the routine by region

The condition guidelines apply across Amazon’s stores. The law around them varies, and so do your procedural rights when Amazon acts.

  • United States. 16 C.F.R. Part 435, in its current form from 79 FR 55619 published September 17, 2014, sets shipping and refund duties for online orders. A seller must have a reasonable basis to ship within the time stated, or within 30 days of a properly completed order when no time is stated. A prompt refund means within 7 working days once the buyer’s right to a refund vests. The rule does not define condition. It is the reason to cancel and refund quickly when no genuinely New unit is on the shelf, instead of shipping an opened one. Your relationship with Amazon itself runs under the Business Solutions Agreement and program policies.
  • United Kingdom. Section 11 of the Consumer Rights Act 2015, in force since 1 October 2015, treats every contract to supply goods by description as including a term that the goods will match the description. A unit listed as New that is not new fails that term. UK sellers on amazon.co.uk are outside the EU Digital Services Act. Their procedural rights come from the Platform-to-Business Regulation 2019/1150 as retained in UK law, which has applied since 12 July 2020. Article 4 requires a statement of reasons on a durable medium when offers are restricted or suspended, and at least 30 days’ notice with reasons before the whole service is terminated. That notice period does not apply where Amazon can show the seller repeatedly infringed its terms, which is the exact pattern repeated condition complaints create.
  • European Union. Directive (EU) 2019/771, which member states had to apply from 1 January 2022, requires goods under Article 6(a) to be of the description, type, quantity and quality the contract requires. Under Article 10 the seller is liable for a lack of conformity that appears within two years of delivery, and under Article 11 a defect that shows within one year is presumed to have existed at delivery. Sellers in EU stores also hold rights under the Digital Services Act, Regulation (EU) 2022/2065, which has applied in full since 17 February 2024. Article 17 gives a clear and specific statement of reasons when a listing is restricted. Article 20 gives at least six months after the decision to lodge a free internal complaint. Article 21 opens certified out-of-court dispute settlement.

Sellers who have been through a condition removal often meet the same reviewers on other listing problems, so the same evidence habits carry over to restricted product listing removals, product compliance documents and category and brand ungating, where condition rules for used sales often apply.

Frequently Asked Questions

What does New mean on Amazon?

New means brand new with the original manufacturer warranty, per the condition guidelines. Amazon defines it as a brand-new item whose original manufacturer’s warranty, if any, still applies, with original packaging present for most items. Some items, such as shoes, may be re-boxed.

What is a used sold as new complaint?

It is a buyer report that an item listed as New was used, damaged or opened. Amazon reviews the report against its condition guidelines. Where the complaint is upheld, the listing can be removed and the violation counts against Account Health.

What happens after these complaints?

The listing can be removed and Account Health points deducted. Amazon includes its product condition guidelines in the Account Health Rating, and repeat violations of the same policy carry more weight within the 180-day window.

Can repeated condition complaints deactivate me?

Yes, repeated complaints can lead to deactivation. Amazon’s Account Health Rating policy states that an account can be at immediate risk of deactivation when it reaches the maximum number of repeat violations for one policy in 180 days, which can be as low as two for higher severity violations.

Can returned items be sold as New?

Only if they meet the New definition, so inspect and regrade returns. A returned unit that is factory sealed, complete and undamaged can go back to New stock. Anything opened, used or missing parts goes to the matching used condition or out of sale.
